Published case that upheld the constitutionally protected right to a jury trial in a divorce case where one of the parties was either late to or absent from court. The decision was a rare case when the Georgia Supreme Court reversed itself in a motion for reconsideration.
CASE – NON-PRECEDENTIAL SUMMARY ORDER Nizarali v. Holder, 09-2268 (2nd Cir. 2010):
The Second Circuit Court of Appeals granted the petition for review and remanded the case back to the Board of Immigration Appeals. The Second Circuit Court of Appeals granted the non-citizen's motion to reopen exclusion proceedings.
